1. validity
The following terms and conditions apply exclusively to all deliveries and services offered and processed via our online store. For other services (especially to business customers) separate terms and conditions apply.
2 Conclusion of contract, minimum order value, printout of order data
The offers presented in our online store are subject to change. There is no minimum order value for online orders. By submitting your order, you are making a legally binding offer to purchase. However, a purchase contract is only concluded when we accept your order by delivering the goods.
We will confirm receipt of your order by e-mail. You can cancel any order free of charge until 8.00 a.m. on the morning of the following working day. This is without prejudice to your right of withdrawal (see section 5 below).
We also reserve the right to cancel an order. This applies in particular in the event that no payment is received within 14 days of placing the order.
Beyond the order data required to process the order, the individual contract text is not stored by us. It can therefore no longer be retrieved by you after completion of the order process. However, you can save or print out the data of your order.
3 Prices, shipping costs
All prices stated on the website are in euros and include the applicable value added tax.
4 Deliveries to other countries require prior agreement.
4 Payment, delivery
1. the purchase price is due immediately upon ordering. Payment can only be made by credit card, PayPal or prepayment.
2. in the case of advance payment, please transfer the invoice amount to the following account, stating the order number in the reason for payment: Berliner Sparkasse, IBAN: DE64 1005 0000 0190 6014 77, BIC: BELADEBEXXX
3. the goods will only be delivered after receipt of your payment. It will be sent to the delivery address you have specified. Insofar as this is reasonable for you, we are entitled to make partial deliveries. You will not incur any additional shipping costs as a result.
5. CANCELLATION POLICY
Right of withdrawal
Due to our work with perishable foods, our products are excluded from the right of withdrawal according to §312g. However, as we are very interested in ensuring that our pars praline editions and other pars products give pleasure, we consider it a goodwill gesture that if the ordered pralines or desserts arrive at the customer severely damaged due to transportation, we will make a new shipment by individual arrangement. However, for this purpose we must be contacted within 24 hours (Tel: +49 (0)176 576 965 91) and a photo of the damaged products must also be sent to our email address.
It is at our discretion to decide the degree of damage at which we will decide to manufacture a new product, as this always involves a great deal of work and expense.
6 Warranty
In the event of defects in the delivered goods, you are entitled to the statutory warranty rights.
However, the special provisions of Section 7 shall apply to any claims for damages against us.
7 Liability
Our liability for damages, irrespective of the legal grounds (in particular in the event of default, defects or other breaches of duty), shall be limited to the foreseeable damage typical of the contract.
The above limitation of liability shall not apply to our liability for intentional conduct or gross negligence, for guaranteed characteristics, for injury to life, limb or health or under the Product Liability Act.

9. choice of law
All legal relationships between you and us shall be governed exclusively by German law to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The applicability of mandatory standards of the country in which you have your habitual residence at the time of conclusion of the contract remains unaffected by this choice of law, as does the applicability of mandatory international private law provisions.
10. alternative dispute resolution pursuant to Art. 14 para. 1 ODR-VO and §36 VDBG:
The European Commission provides a platform for online dispute resolution (OS), which you can find at http://ec.europa.eu/consumers/odr/. Consumers have the option of using this platform to resolve their disputes. We are generally prepared to participate in an out-of-court dispute resolution procedure.
11. final provisions
Should individual provisions of these terms and conditions be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions.
